1:Prevention & Legal Capacity
The MAH SPIRIT Online Store is reserved exclusively for users aged 18 years old and above. By placing an order, the Buyer explicitly certifies they meet this age requirement. Delivery personnel reserve the right to demand official identification upon handover.
2: The Online Store & Product Characteristics
The online store showcases the essential characteristics, technical specifications, and total billing price (inclusive of taxes and mandatory duties) for each product. Product photography is provided for illustrative purposes only; slight variations in bottling, seals, or packaging elements do not represent a breach of contract. MAH SPIRIT reserves the right to correct accidental technical errors or omissions within product sheets at any time.
3: Orders & Formation of Contract
All orders are placed with an explicit obligation to pay. A contract is only considered firmly formed once the customer completes all mandatory fields (Personal Details, Delivery Options, and Payment Method) and clicks the final confirmation button. MAH SPIRIT will immediately issue a confirmation email. We reserve the right to cancel or suspend any order if a buyer fails to comply with these terms, or if the ordered quantities are abnormally high compared to standard consumer behavior.
4: Stock Availability & Outages
Products are offered strictly while stocks last. Should a product become unavailable after order confirmation, MAH SPIRIT will notify the buyer immediately. We may offer a replacement item of equivalent quality and value. If the buyer disagrees, a full refund of the amount paid will be issued within fourteen (14) days.
5: Pricing, Taxes, and Custom Duties
All billing is executed exclusively in Euros (€). Prices are listed inclusive of all French taxes (TTC), including standard VAT and mandated EU excise duties on pure alcohol. Delivery costs are calculated dynamically based on the shipping method and destination, and are clearly broken down prior to checkout. For any international shipments outside the EU, local customs clearings, import levies, and regional taxes are the sole structural responsibility of the buyer.
6: Payment Methods
Payment is due in full at the time of ordering. Accepted payment methods include secure debit/credit card processing and direct bank transfers. For bank transfers, funds must settle within ten (10) business days, or the order will be automatically voided and returned to active inventory.
7: Retention of Title & Transfer of Risk
MAH SPIRIT retains total, absolute legal ownership of all shipped products until principal payment and associated delivery fees have cleared in full. The physical transfer of risk (loss, theft, or breakage) passes entirely to the consumer the exact moment the package is delivered to the specified address or handed over to a custom courier designated by the buyer.
8: Right of Withdrawal & Returns
In accordance with EU consumer directives, the buyer has a fourteen (14) day cooling-off period from physical receipt to declare a withdrawal.Crucial Exception: Due to health protection, hygiene, and product safety regulations, the right of withdrawal is completely voided for any alcoholic beverages where the bottle seal has been broken, opened, or altered by the consumer post-delivery.To initiate a valid return for sealed items, contact contact@mahspirit.com. Return shipping costs are borne entirely by the buyer. Approved refunds will be issued within 14 days of the goods arriving back at our facility in their original transit condition.
9: Intellectual Property
The website layout, underlying code, visual assets, bottle graphics, and logos remain the exclusive intellectual property of MAH SPIRIT. Any unauthorized downloading, full or partial reproduction, or distribution of these elements for commercial use is strictly prohibited.
10: Governing Law & Jurisdiction
These General Conditions of Sale are governed exclusively by French law. Any litigation, dispute, or non-resolution arising from commercial transactions on this website shall fall under the exclusive jurisdiction of the competent courts of Paris, France.
